Hershey and Bogdon Settle Court Dispute

KANSAS CITY -- Bogdon Candy here and Hershey Foods, Hershey, Penn., have resolved their dispute involving Bogdon's trademark RECEPTION STICKS.

In November of 1999, Bogdon brought an action in the Federal Court in Kansas City charging Hershey with trademark infringement and unfair competition as a result of the generic and descriptive use by Hershey of the RECEPTION STICKS trademark. The parties were able to resolve their difference through mediation by an alternative dispute resolution procedure.

Hershey agreed to discontinue use of the term RECEPTION STICK and therefore Bogdon dismissed its complaint. Hershey also dismissed it counterclaim which alleged that the Bogdon trademark was a generic name for stick-shaped candies used as hospitality favors.
