PARSIPPANY, N.J. -- Marks & Spencer said last week the exclusivity period for Gristede's Foods, New York, to negotiate a definitive stock purchase agreement to acquire Kings Super Markets has ended without a deal being reached.

sman declined to identify the other company, but industry sources told SN the company is D'Agostino Supermarkets, Larchmont, N.Y., which had previously said it was interested in acquiring Kings.

John Catsimatidis, Gristede's majority stockholder, chairman and chief executive officer, told SN he is still interested in buying Kings as well. He said he has set aside his effort to raise $175 million in senior notes to fund the acquisition and is instead "looking at other financial options."

D'Agostino could not be reached for comment.
