FLEMING COS., Oklahoma City, lost a court battle when the Fifth Circuit Court of Appeals in Dallas affirmed dismissal of all claims by the company against William D. Sims Jr., the attorney who represented David's Supermarkets, Grandview, Texas, in a 1996 suit against the distributor. The appeals court upheld the dismissal a year ago by a federal district court judge in Lubbock, Texas.

A&P, Montvale, N.J., reportedly plans to close the 375,000-square-foot Waldbaum's distribution center in Central Islip, New York, in December and shift that volume to A&P facilities in Edison and North Bergen, N.J. The company could not be reached for comment last week. The reported closing comes a couple of weeks after the company said it will close its 322,000-square-foot warehouse in Florence, N.J., and shift that volume to A&P facilities in Edison, N.J., and Baltimore, Md., as part of an efficiency move to consolidate East Coast distribution.
