BUFFALO, N.Y. -- Tops Markets here ran a full-page ad touting "The Magic of Cakes" late last month.

In addition, eight photos of sheet and round cakes were shown. They had theme decorations such as Father's Day, graduation and first communion. Under the headline, "The Magic of Cakes," the ad read, "We make that special occasion a piece of cake."
The ad said two types of frosting were available: butter creme and satin creme, which was described as "light and fluffy."
Another paragraph read, "At the last party you went to and raved about the cake, odds are that it came from Tops. We sell more cakes than anyone else in the area for a good reason ... they taste great."
The ad then listed "cake occasions." Besides the usual birthday and other rite-of-passage events, the list included rehearsal dinners, bridal showers, promotion parties, corporate meetings and retreats, retirement parties and reunions.
