FTC Delays Whole Foods Hearing

The Federal Trade Commission said yesterday it would postpone the start of its administrative hearing against the Whole Foods acquisition of Wild Oats until April 6, 2009.

WASHINGTON — The Federal Trade Commission said yesterday it would postpone the start of its administrative hearing against the Whole Foods acquisition of Wild Oats until April 6, 2009.

The hearing had been schedule to begin on Feb. 16, 2009, but Whole Foods had asked for an extension until at least September, pending the outcome of the ongoing hearing about the case in the federal court system.

The FTC said yesterday that an extension was warranted because the outcome of the federal hearing, in which a district court judge is reconsidering the FTC's request for an injunction to suspend the merger, could impact the FTC's administrative hearing.
