BOSTON — A Superior Court judge here who refused to allow Wal-Mart to settle a class-action lawsuit involving off-the-clock work and shortened breaks has scheduled the case to go to trial Oct. 5, according to published reports.

Wal-Mart had reportedly reached an agreement to pay as much as $40 million to settle the suit prior to trial, but the court refused to grant preliminary approval to the deal, saying the attorneys with whom the company made the deal were no longer active in the case.
