WASHINGTON — The National Association of Community Drug Stores and the National Community Pharmacists Association, both in Alexandria, Va., filed a lawsuit this week against the U.S. Department of Health and Human Services here and the Centers for Medicare and Medicaid Service, Baltimore. The suit challenges the government-imposed reductions to Medicaid drug reimbursements paid to retail pharmacies. Set to take effect in January, the reductions will be made through a new calculation of the reimbursement. That calculation is inaccurate, according to the associations. “We would prefer to have legislation in place [to solve the problem] but would like to protect out rights in the meantime,” said Don Bell, legal counsel for NACDS, during a conference call.
