PORTLAND, Ore. — New Seasons Market here reportedly plans to appeal a judge's decision last week that would force it to comply with a subpoena related to the Whole Foods antitrust case.
New Seasons, a seven-store, natural and organic retailer, has been fighting the subpoena, in which Whole Foods is asking for the company's sales records and other data to bolster its case that its acquisition of Wild Oats was not anticompetitive.
