Court Upholds $18M Award for Marsh: Report

INDIANAPOLIS — The Indiana Court of Appeals has upheld an $18 million judgment for Marsh Supermarkets stemming from a dispute over a sublease of its former headquarters, published reports said.

According to the Indianapolis Star newspaper, the pharmaceutical company Roche had agreed to lease space at Marsh’s former headquarters in 2008 but later objected to certain terms in the lease. The latest ruling upheld a 2011 decision by a lower court.

The article explained that Roche had negotiated the sublease just as the real estate market began falling, which ended up lowering rents and creating vacancies before the pharmaceutical company had even fully moved into the space in Marsh's building.
