ABA Applauds Soda Ban Ruling

NEW YORK — The American Beverage Association is pleased with a New York City appeals court’s decision to uphold the ruling made last spring against mayor Mike Bloomberg’s soda ban.

Last March, a New York Supreme Court justice blocked the ban a day before it was to take effect, ruling that the city Board of Health lacked the authority to promulgate the restriction. Mayor Bloomberg, who proposed the measure to curb obesity, unsuccessfully appealed the decision.

“With this ruling behind us, we look forward to collaborating with city leaders on solutions that will have a meaningful and lasting impact on the people of New York City,” said the ABA in a statement.

In collaboration with the National Restaurant Association and other businesses, the ABA filed a lawsuit last October seeking to block the restriction that would have prohibited restaurants, food carts, movie theater concession stands and other establishments that receive an inspection grade from the health department, from selling sweetened drinks in containers larger than 16 ounces.
