Class Action Sought in Hannaford Data Case

PORTLAND, Maine — Plaintiffs in a lawsuit against Hannaford Bros. related to its 2008 data breach have asked a judge to reconsider granting the complaint class-action status.

U.S. District Court Judge Brock Hornby here last month denied class status to the case, saying the four plaintiffs failed to prove damages on a class-wide basis.

In a motion filed last week, the plaintiffs asked the judge to grant them 60 days during which they could present expert testimony in support of the class. The plaintiffs are seeking certification of a class to pursue their claims for fees to obtain new credit cards, and other expenses arising from the security breach at the chain.

A spokesman for Hannaford, a division of Brussels-based Delhaize Group, said the company does not comment on pending litigation.
