BETHLEHEM, Pa. — A Pennsylvania court affirmed Wegmans’ right to sell beer in its Market Cafes here and in its Williamsport, Pa., location, according to reports. The chain obtained restaurant licenses to sell beer (limited to two six-packs) for both on and off-premise consumption from the restaurants, but last March the Pennsylvania Malt Beverage Distributors Association appealed the Pennsylvania Liquor Control Board’s decision, contending that the real beer seller was Wegmans’ supermarket, since its Market Cafes are attached by an interior passageway to the grocery store.
The court’s ruling in Wegmans’ favor also pertains to beer sales at the chain’s restaurants that are attached to stores in Dickson City, Lower Nazareth, State College and Wilkes-Barre, Pa. Wegmans is pursuing similar restaurant licenses for its Warrington, Allentown, Collegeville, Downingtown, Mechanicsburg and Erie locations in the state.
